Splitt-E Consent for GPS, Camera, Microphone, Action Camera and Dashcam Usage

1. Purpose and Scope
This Consent for GPS, Camera, Microphone, Action Camera and Dashcam Usage ("Consent") explains how Splitt-E collects, accesses, processes, stores, uses, shares, and protects location information, camera images, microphone recordings, action camera recordings, dashcam recordings, and related information while Users access or use the Splitt-E Platform.
This Consent applies to all users of the Platform, including passengers, Driver Partners, Delivery Partners, merchants, fleet partners, business partners, and any other persons using Splitt-E services.
By granting the requested permissions, uploading information, enabling applicable features, or continuing to use the Platform after being presented with this Consent, Users expressly acknowledge that they have read, understood, and consent to the practices described herein, subject to applicable law.
2. Purpose of Collection
Splitt-E collects and processes information covered under this Consent to:
Facilitate ride and delivery services.
Verify user identity.
Enhance passenger and driver safety.
Prevent fraud and misuse.
Investigate accidents and complaints.
Improve navigation and trip accuracy.
Resolve disputes.
Enable emergency assistance.
Comply with legal and regulatory obligations.
Improve Platform functionality and security.
Splitt-E only collects information reasonably necessary for these legitimate purposes.
3. Permissions Requested
Depending upon the services used, Splitt-E may request permission to access:
Precise GPS location.
Approximate location.
Camera.
Microphone.
Storage or media.
Action camera recordings.
Dashcam recordings.
Bluetooth or nearby device permissions where required.
Notification permissions for safety features.
Certain Platform features may not function correctly if these permissions are denied.
4. GPS and Location Information
Splitt-E may collect location information before, during, and shortly after a ride or delivery where reasonably necessary to:
Match nearby drivers.
Calculate routes.
Display estimated arrival times.
Monitor trip progress.
Enable live trip sharing.
Detect fraudulent activity.
Improve route optimization.
Investigate complaints.
Support emergency response.
Comply with applicable law.
5. Background Location
Where permitted by applicable law and enabled by the User, Splitt-E may collect background location information while the application is running in the background to:
Maintain trip continuity.
Improve ride matching.
Detect fraud.
Support emergency safety features.
Improve driver availability.
Users may disable background location permissions through their device settings, although doing so may limit certain Platform features.
6. Camera Access
Splitt-E may request camera access for purposes including:
Identity verification.
Selfie or liveness verification.
Profile photographs.
Government document verification.
Vehicle document verification.
Vehicle inspection.
Reporting damaged parcels or vehicles.
Customer support requests.
Other user-initiated Platform features.
Splitt-E does not activate a User's camera without the User's interaction or where otherwise permitted by applicable law.
7. Microphone Access
Splitt-E may request microphone access solely where reasonably necessary for:
In-app voice communication.
Emergency safety features.
Customer support voice submissions.
Voice-enabled Platform functionality.
The microphone will not be activated without appropriate User action or lawful authorization except where emergency features expressly initiated by the User require such access.
8. Action Camera and Dashcam Usage
To enhance safety, transparency, and accountability, Splitt-E may require or permit continuous video recording during trips.
The recording requirements may differ based on the type of vehicle operated.
(a) Two-Wheeler Driver Partners
Two-Wheeler Driver Partners may be required to use a Splitt-E-approved helmet-mounted or body-mounted action camera while providing services through the Platform.
(b) Four-Wheeler Driver Partners
Four-Wheeler Driver Partners may be required to install and maintain a Splitt-E-approved dashboard camera (Dashcam) that complies with applicable technical and legal requirements.
(c) Recording Requirements
Where recording devices are required, Driver Partners shall ensure that such devices:
Remain operational throughout active trips.
Are not intentionally switched off, disabled, disconnected, obstructed, or tampered with.
Have sufficient battery or continuous power supply.
Have adequate storage capacity.
Record in accordance with applicable laws.
Comply with Splitt-E's minimum technical standards.
Passengers acknowledge that safety recordings may occur during trips where applicable.
9. Minimum Technical Standards
Splitt-E may prescribe minimum technical specifications for approved recording devices, including but not limited to:
Minimum video resolution.
Recording quality.
Date and time stamping.
Loop recording capability.
Battery capacity or continuous power support.
Secure storage capability.
Device reliability requirements.
Splitt-E reserves the right to update these technical standards from time to time.
10. Use of Recordings
GPS information, photographs, audio recordings, action camera recordings, and dashcam recordings may be used for:
Passenger safety.
Driver safety.
Emergency response.
Accident investigations.
Fraud prevention.
Insurance claims.
Customer complaints.
Internal investigations.
Law enforcement requests where legally required or permitted.
Regulatory compliance.
Training and quality improvement using appropriately protected or de-identified information where applicable.
11. Passenger Notification
Where action cameras or dashcams are required or used, Splitt-E may notify passengers through the Platform, in-app notices, booking information, or visible labels indicating that trips may be subject to safety recording in accordance with applicable laws.
12. Emergency Safety Features
Where enabled, emergency safety features may temporarily access GPS, camera, microphone, or other device capabilities to:
Share live location.
Notify emergency contacts.
Preserve relevant evidence.
Assist emergency responders.
Support investigations into serious incidents.
These features operate only in accordance with Platform functionality and applicable law.
13. Sharing of Information
Splitt-E may share information collected under this Consent only where reasonably necessary with:
Identity verification providers.
Cloud service providers.
Mapping and navigation providers.
Payment service providers.
Insurance partners.
Emergency service providers.
Customer support providers.
Professional advisers.
Regulatory authorities.
Courts or law enforcement agencies where required or permitted by law.
Other parties with the User's consent.
Splitt-E does not sell personal information collected solely under this Consent.
14. Data Security
Splitt-E implements reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, alteration, disclosure, misuse, or destruction.
Although reasonable safeguards are maintained, no security system can guarantee absolute protection.
15. Data Retention
Information covered by this Consent may be retained for as long as reasonably necessary to:
Operate the Platform.
Resolve disputes.
Investigate complaints.
Prevent fraud.
Enforce legal rights.
Process insurance claims.
Comply with legal, tax, accounting, regulatory, or governmental obligations.
After applicable retention periods expire, information may be securely deleted, anonymized, or otherwise processed in accordance with applicable law.
16. User Controls
Users may manage many permissions through their device operating system settings.
Disabling certain permissions may restrict or prevent access to particular Platform features.
17. Withdrawal of Consent
Where consent serves as the legal basis for processing, Users may withdraw consent at any time by modifying device permissions or contacting Splitt-E, subject to applicable law.
Withdrawal of consent shall not affect the lawfulness of processing undertaken before such withdrawal and may limit the User's ability to access certain Platform services.
18. User Responsibilities
Users shall not:
Manipulate GPS information.
Submit false photographs or recordings.
Tamper with safety recordings.
Disable mandatory recording devices.
Record individuals unlawfully.
Misuse Platform permissions.
Interfere with the operation of required safety equipment.
19. Third-Party Technologies
Certain Platform features rely upon third-party technologies, including mapping providers, cloud infrastructure providers, communication providers, verification providers, emergency service integrations, analytics providers, and recording hardware.
Such providers shall process information only as permitted under applicable law and contractual obligations.
20. Children's Privacy
Splitt-E does not knowingly collect personal information directly from children except where permitted by applicable law and reasonably necessary for providing requested services.
Additional safeguards may apply where information relating to minors is processed.
21. Compliance with Applicable Laws
All collection, processing, storage, sharing, and use of information covered under this Consent shall be carried out in accordance with applicable privacy, data protection, transportation, consumer protection, and other relevant laws.
Nothing in this Consent limits any rights available to Users under applicable law.
22. Amendments
Splitt-E may amend this Consent from time to time to reflect changes in technology, safety practices, legal requirements, operational needs, or Platform functionality.
Where required by applicable law, material changes will be communicated before taking effect.
Continued use of the Platform after such changes constitutes acceptance of the updated Consent unless applicable law provides otherwise.

24. Acknowledgement and Consent
By granting the requested permissions, enabling applicable safety features, using required recording devices where applicable, or continuing to access or use the Splitt-E Platform after being presented with this Consent, Users acknowledge that they have read, understood, and voluntarily consent to the collection, use, processing, storage, sharing, and protection of information as described in this Consent, subject to applicable law.
